Fymble Terms and Conditions
By downloading, installing, or using the Fymble mobile application (“App,” “Service,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Fymble.
2. ACCEPTANCE OF TERMS
By using Fymble, you confirm that:
- You are at least 18 years of age (or 16 in the European Economic Area)
- You have the legal capacity to enter into these Terms
- You will comply with these Terms and all applicable laws and regulations
- All information you provide is accurate and truthful
3. USER ACCOUNT AND ELIGIBILITY
3.1 Age Requirements
- You must be at least 18 years old to use Fymble (or 16 in the European Economic Area)
- Users under 18 require parental or guardian consent
- We do not knowingly collect information from children under the required age
3.2 Account Registration
To use certain features, you must:
- Create an account with accurate information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
3.3 Account Termination
We reserve the right to suspend or terminate your account if you:

- Engage in fraudulent activity
- Misuse the App or harm other users
- Violate applicable laws or regulations
4. SUBSCRIPTION AND PAYMENT TERMS
4.1 Free and Premium Features
Fymble offers both free and premium subscription features. Subscription details, pricing, and features are displayed in the App and may change from time to time.
4.2 Subscription Plans
- Monthly Subscription: Billed monthly until cancelled
- Annual Subscription: Billed annually until cancelled
4.3 Billing and Renewals
Automatic Renewal:
- Subscriptions automatically renew unless cancelled before the renewal date
- You will be charged the then-current subscription price
- Renewals occur through Google Play Store or Razorpay account
- You will receive notice of price changes in accordance with applicable laws
Payment Processing:
- Payments are processed through Google Play Store or Razorpay
- We do not store your payment card information
4.4 Free Trials
- Free trial periods (7 days) are available to new users only
4.5 Cancellation Policy (Click-to-Cancel Compliance)
Easy Cancellation:
For Android Users (Google Play Store):
- Open Google Play Store app
- Tap Menu > Subscriptions
- Select Fymble
- Tap “Cancel Subscription”
In-App Cancellation:
- Navigate to Fymble Subscription > Cancel
- Follow the cancellation instructions for your platform
Important Cancellation Terms:
- Cancellations take effect at the end of the current billing period
- You retain access to premium features until the end of the paid period
- You can re-subscribe at any time
- No penalties or fees for cancellation
- No requirement to contact customer service to cancel
4.6 Price Changes
- We reserve the right to change subscription prices
- Price changes will not affect your current subscription period
- You will be notified at least 30 days before any price increase
- Continued use after price increase constitutes acceptance
5. ACCEPTABLE USE POLICY
5.1 Permitted Uses
You may use Fymble for:
- Personal health and fitness tracking
- Accessing workout plans and nutrition recommendations
- Tracking progress and setting goals
- Using AI-powered features for personalized insights
- Connecting with friends and community features
5.2 Prohibited Uses
You may NOT:
- a) Violate Laws or Rights:
- Use the App for any illegal purpose
- Violate any local, state, national, or international law
- Infringe on intellectual property rights of others
- Violate privacy rights or data protection laws
- b) Misuse the Service:
- Share your account credentials with others
- Create multiple accounts to abuse promotions or trials
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to our systems
- Introduce viruses, malware, or harmful code
- Use automated systems (bots, scrapers) to access the App
- c) Harmful Content:
- Upload or share inappropriate, offensive, or harmful content
- Promote eating disorders, dangerous diets, or unhealthy practices
- Share medical advice or diagnoses
- Impersonate others or misrepresent your identity
- Harass, abuse, or harm other users
- d) Commercial Misuse:
- Use the App for commercial purposes without authorization
- Resell or redistribute App content or services
- Use content for training competing AI models
- Scrape or collect user data
- e) Abuse AI Features:
- Attempt to manipulate or exploit AI-generated content features
- Generate content that violates our content policies
- Use AI features to create harmful, misleading, or inappropriate health advice
5.3 Reporting Violations
If you encounter content or behavior that violates these Terms, please report it through:

6. AI-GENERATED CONTENT TERMS
6.1 Use of Artificial Intelligence
Fymble uses artificial intelligence, including our “Kyra AI” feature, to provide:
- Personalized workout recommendations
- Nutrition and meal planning suggestions
- Health insights and coaching tips
- Exercise form guidance
- Motivational content
6.2 AI Content Disclaimers
You acknowledge and agree that:
- a) Not Professional Advice: AI-generated content is not a substitute for professional medical, nutritional, or fitness advice from qualified professionals.
- b) General Recommendations: AI recommendations are based on general fitness principles and your provided data, not individual medical assessment.
- c) Accuracy Limitations: AI-generated content may contain errors, inaccuracies, or inappropriate recommendations.
- d) No Guarantees: We do not guarantee that AI recommendations will achieve specific results or be suitable for your individual needs.
- e) User Responsibility: You are responsible for evaluating AI-generated content and determining its appropriateness for your situation.
- f) Verification Required: Always verify AI-generated advice with qualified healthcare professionals before implementation.
7.3 AI Safety Measures
We implement safeguards to prevent AI from generating:
- Dangerous or harmful health advice
- Content promoting eating disorders or unhealthy practices
- Misleading medical information
- Inappropriate or offensive content
However, no AI system is perfect. You must use your judgment and report any inappropriate AI-generated content immediately.
6.4 Reporting AI Issues
You can report problematic AI-generated content through:

Reports help us improve AI safety and accuracy.
6.5 AI Training and Your Data
- We do NOT use your personal health data to train our AI models without explicit consent
- AI models are trained on publicly available fitness and nutrition information
- Your feedback on AI content helps improve recommendations but is anonymized
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Our Rights
All content, features, and functionality of Fymble, including but not limited to:
- Text, graphics, logos, images, and icons
- Software code and architecture
- AI models and algorithms
- Workout plans and templates
- Nutritional databases
- User interface designs
…are owned by Fymble and are protected by copyright, trademark, patent, and other intellectual property laws.
7.2 Your License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Use the App for personal, non-commercial purposes
- Access content for your individual health and fitness tracking
- Download and use the mobile application on your devices
You may NOT:
- Copy, modify, or create derivative works
- Distribute, sell, or transfer the App or its content
- Remove copyright or proprietary notices
- Use our trademarks without written permission
7.3 User-Generated Content
What You Share:
When you post, upload, or share content through Fymble (posts, comments, photos, achievements), you retain ownership but grant us a license.
License Grant:
By sharing content, you grant Fymble a worldwide, non-exclusive, royalty-free, transferable license to:
- Use, reproduce, and display your content within the App
- Share content with other users as directed by you
- Improve our services and features
We will NOT:
- Sell your personal content to third parties
- Use your personal health data in external advertising
- Share your content beyond the scope of App functionality
Your Responsibilities:
You represent and warrant that:
- You own or have rights to any content you share
- Your content does not violate any third-party rights
- Your content complies with these Terms and applicable laws
Removal Rights:
We reserve the right to remove any user content that:
- Violates these Terms
- Infringes on rights of others
- Is inappropriate, offensive, or harmful
- Violates applicable laws
8. THIRD-PARTY SERVICES AND INTEGRATIONS

Fymble integrates with:
- Google Health Connect (Android)
- Apple HealthKit (iOS)
Your use of these services is governed by their respective terms and policies.
8.2 Third-Party Links
The App may contain links to third-party websites, services, or content. We:
- Do not control or endorse third-party services
- Are not responsible for third-party content or practices

8.3 Data Sharing with Third Parties

- Accuracy or reliability of content

10.2 Limitation of Damages
IN NO EVENT SHALL FYMBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:
- a) Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
- b) Health Outcomes: Any injuries, health complications, or adverse effects resulting from using the App or following recommendations
- c) Data Loss: Loss of data, profits, revenue, or business opportunities
- d) Third-Party Actions: Actions or omissions of third parties
- e) AI-Generated Content: Errors, inaccuracies, or consequences of AI-generated recommendations
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Fymble, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of third parties
- Your violation of applicable laws or regulations
- Content you post or share through the App
- Health consequences from following App recommendations
- Any negligent or wrongful conduct
12. Gym Rewards & XP Points
12.1 Accuracy of Information
We strive for accuracy but do not guarantee that:
- Nutritional information is 100% accurate
- Calorie calculations are precise
- Exercise metrics are exact
- AI-generated content is error-free
- Third-party integrations work perfectly
12.2 No Guarantee of Results
We do not guarantee that using Fymble will result in:
- Weight loss or muscle gain
- Improved fitness or health outcomes
- Achievement of specific goals
- Any particular results
Individual results vary based on numerous factors beyond our control.
12.3 Service Availability
We do not guarantee that:
- The App will be available 24/7 without interruptions
- All features will work on all devices
- Services will be error-free or bug-free
- Data will never be lost
We reserve the right to modify, suspend, or discontinue any part of the App at any time.
13. MODIFICATIONS TO TERMS AND SERVICE
13.1 Changes to Terms
We may modify these Terms at any time. When we do:
- We will update the “Last Updated” date
- We will notify you through the App or email
- Material changes will be effective 30 days after notice
- Continued use after changes constitutes acceptance
If you do not agree to modified Terms, you must stop using the App and cancel your subscription.
13.2 Changes to the App
We reserve the right to:
- Add, modify, or remove features
- Change pricing or subscription plans (with notice)
- Update AI algorithms and recommendations
- Discontinue the App or specific features
We will provide reasonable notice of material changes that negatively affect your experience.
14. TERMINATION

You may terminate your use of Fymble at any time by:
- Cancelling your subscription (if applicable)
- Deleting your account through App settings
- Uninstalling the App from your devices
14.2 Termination by Us
We may suspend or terminate your access immediately if:
- You violate these Terms
- You engage in fraudulent activity
- Your account is inactive for an extended period
- We discontinue the service
- Required by law or regulatory authorities
14.3 Effects of Termination
Upon termination:
- Your right to use the App immediately ceases
- You lose access to premium features and content
- Your data may be deleted in accordance with our Privacy Policy
- No refunds for unused subscription periods (except as required by law)
- Provisions that by nature should survive will continue (liability limitations, indemnification, etc.)
15. DISPUTE RESOLUTION
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Bangalore Jurisdiction, without regard to conflict of law principles.
15.2 Informal Resolution
Before filing a claim, you agree to contact us at support@fymble.app to attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days.
16. PLATFORM-SPECIFIC TERMS
16.1 Apple App Store Users
For users who download Fymble ittbot from the Apple App Store:
- These Terms are between you and Fymble, not Apple
- Apple has no obligation to provide support or maintenance
- Apple is not responsible for the App or its content
- Apple is a third-party beneficiary of these Terms
- In case of third-party intellectual property infringement claims, Fymble (not Apple) is responsible
16.2 Google Play Store Users
For users who download Fymble from Google Play Store:
- These Terms are between you and Fymble, not Google
- Google has no obligation or liability concerning the App
• Your use must comply with Google Play’s Terms of Service
17. GENERAL PROVISIONS
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fymble regarding the App.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
17.3 No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.
17.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or government actions.

We may provide notices to you:

- By email to your registered email address
- By posting on our website

These Terms are provided in English. Translated versions may be provided for convenience, but the English version governs in case of conflicts.
