Fymble Terms and Conditions

By downloading, installing, or using the Fymble mobile application (“App,” “Service,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Fymble.

1. Platform Overview

Fymble is a fitness and wellness platform that enables users to:
  • Book daily gym pass (pay-per-use basis)
  • Access AI-powered food analysis and calorie insights
  • Purchase nutrition consultation services
  • Book Fitness Class and Membership plans
  • Connect with workout partners through Gym Mate
  • Track your diet, workout, steps and water intake

2. Acceptance of Terms

By using Fymble, you confirm that:
  • You are at least 18 years of age (or 16 in the European Economic Area)
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws and regulations
  • All information you provide is accurate and truthful

3. User Account and Eligibility

3.1 Age Requirements

  • You must be at least 18 years old to use Fymble (or 16 in the European Economic Area)
  • Users under 18 require parental or guardian consent
  • We do not knowingly collect information from children under the required age

3.2 Account Registration

To use certain features, you must:
  • Create an account with accurate information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:
  • Violate these Terms
  • Provide false or misleading information
  • Engage in fraudulent activity
  • Misuse the App or harm other users
  • Violate applicable laws or regulations

4. Nutrition Plans & AI Food Scanner

  • Nutrition services include video consultations with certified nutritionists
  • Personalized diet plans are created based on user-provided information
  • WhatsApp support is provided for follow-ups and guidance

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Fymble for:

  • Accessing workout plans and nutrition recommendations
  • Tracking progress and setting goals
  • Using AI-powered features for personalized insights
  • Connecting with friends and community features

5.2 Prohibited Uses

You may NOT: a) Violate Laws or Rights:
  • Use the App for any illegal purpose
  • Violate any local, state, national, or international law
  • Infringe on intellectual property rights of others
  • Violate privacy rights or data protection laws
b) Misuse the Service:
  • Share your account credentials with others
  • Create multiple accounts to abuse promotions or trials
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to our systems
  • Introduce viruses, malware, or harmful code
  • Use automated systems (bots, scrapers) to access the App
c) Harmful Content:
  • Upload or share inappropriate, offensive, or harmful content
  • Promote eating disorders, dangerous diets, or unhealthy practices
  • Share medical advice or diagnoses
  • Impersonate others or misrepresent your identity
  • Harass, abuse, or harm other users
d) Commercial Misuse:
  • Use the App for commercial purposes without authorization
  • Resell or redistribute App content or services
  • Use content for training competing AI models
  • Scrape or collect user data
e) Abuse AI Features:
  • Attempt to manipulate or exploit AI-generated content features
  • Generate content that violates our content policies
  • Use AI features to create harmful, misleading, or inappropriate health advice

6.1 Use of Artificial Intelligence

Fymble uses artificial intelligence, including our “Kyra AI” feature, to provide:

  • Nutrition and meal planning suggestions
  • Health insights and coaching tips

  • Motivational content

6.2 AI Content Disclaimers

You acknowledge and agree that:
  • Not Professional Advice: AI-generated content is not a substitute for professional medical, nutritional, or fitness advice from qualified professionals.
  • General Recommendations: AI recommendations are based on general fitness principles and your provided data, not individual medical assessment.
  • Accuracy Limitations: AI-generated content may contain errors, inaccuracies, or inappropriate recommendations.
  • No Guarantees: We do not guarantee that AI recommendations will achieve specific results or be suitable for your individual needs.
  • User Responsibility: You are responsible for evaluating AI-generated content and determining its appropriateness for your situation.
  • Verification Required: Always verify AI-generated advice with qualified healthcare professionals before implementation.

6.3 AI Safety Measures

We implement safeguards to prevent AI from generating:
  • Dangerous or harmful health advice
  • Content promoting eating disorders or unhealthy practices
  • Misleading medical information
  • Inappropriate or offensive content
However, no AI system is perfect. You must use your judgment and report any inappropriate AI-generated content immediately.

6.4 Reporting AI Issues

6.5 AI Training and Your Data

  • We do NOT use your personal health data to train our AI models without explicit consent
  • AI models are trained on publicly available fitness and nutrition information
  • Your feedback on AI content helps improve recommendations but is anonymized

7. Intellectual Property Rights

7.1 Our Rights

All content, features, and functionality of Fymble, including but not limited to:
  • Text, graphics, logos, images, and icons
  • Software code and architecture
  • AI models and algorithms
  • Workout plans and templates
  • Nutritional databases
  • User interface designs
…are owned by Fymble and are protected by copyright, trademark, patent, and other intellectual property laws.

7.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:
  • Use the App for personal, non-commercial purposes
  • Access content for your individual health and fitness tracking
  • Download and use the mobile application on your devices
You may NOT:
  • Copy, modify, or create derivative works
  • Distribute, sell, or transfer the App or its content
  • Remove copyright or proprietary notices
  • Use our trademarks without written permission

7.3 User-Generated Content

When you post content through Fymble, you retain ownership but grant us a license. By sharing content, you grant Fymble a worldwide, non-exclusive, royalty-free, transferable license to:

  • Improve our services and features
We will NOT:
  • Sell your personal content to third parties
  • Use your personal health data in external advertising
  • Share your content beyond the scope of App functionality
We reserve the right to remove any user content that violates these Terms, infringes on rights of others, is inappropriate, offensive, or harmful, or violates applicable laws.

8. Third-Party Services and Integrations

Fymble integrates with:
  • Google Health Connect (Android)
  • Apple HealthKit (iOS)
Your use of these services is governed by their respective terms and policies.

8.2 Third-Party Links

The App may contain links to third-party websites, services, or content. We:
  • Do not control or endorse third-party services
  • Are not responsible for third-party content or practices
  • Recommend reviewing third-party terms and privacy policies

8.3 Data Sharing with Third Parties

We limit third-party data sharing as described in our Privacy Policy. Health and fitness data is NOT sold or shared for advertising purposes.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Uninterrupted or error-free operation

10.2 Limitation of Damages

IN NO EVENT SHALL FYMBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:
  • Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
  • Health Outcomes: Any injuries, health complications, or adverse effects resulting from using the App or following recommendations
  • Data Loss: Loss of data, profits, revenue, or business opportunities
  • Third-Party Actions: Actions or omissions of third parties
  • AI-Generated Content: Errors, inaccuracies, or consequences of AI-generated recommendations

11. Indemnification

You agree to indemnify, defend, and hold harmless Fymble, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:
  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your violation of applicable laws or regulations
  • Content you post or share through the App
  • Health consequences from following App recommendations
  • Any negligent or wrongful conduct

12. Check In at Fitness Studios

12.1 Daily Pass & Fitness Class

Users can check-in at the fitness studio by two ways:
  • Scan the QR code that is present in the partner gyms
  • Allow gym admin to scan the pass QR
User can check-in using any one of the above methods.

12.2 Membership Plans

Membership plan gets activated upon successful purchase and verification at the partner studio.

13. Modifications to Terms and Service

13.1 Changes to Terms

We may modify these Terms at any time. When we do:
  • We will update the “Last Updated” date
  • We will notify you through the App or email
  • Material changes will be effective 30 days after notice
  • Continued use after changes constitutes acceptance
If you do not agree to modified Terms, you must stop using the App.

13.2 Changes to the App

We reserve the right to:
  • Add, modify, or remove features
  • Change pricing (with notice)
  • Update AI algorithms and recommendations
  • Discontinue the App or specific features
We will provide reasonable notice of material changes that negatively affect your experience.

14. Termination

14.1 Termination by You

You may terminate your use of Fymble at any time by:
  • Deleting your account through App settings
  • Uninstalling the App from your devices

14.2 Termination by Us

We may suspend or terminate your access immediately if:
  • You violate these Terms
  • You engage in fraudulent activity
  • Your account is inactive for an extended period
  • We discontinue the service
  • Required by law or regulatory authorities

14.3 Effects of Termination

Upon termination:
  • Your right to use the App immediately ceases
  • You lose access to premium features and content
  • Your data may be deleted in accordance with our Privacy Policy
  • Provisions that by nature should survive will continue (liability limitations, indemnification, etc.)

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Bangalore Jurisdiction, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at support@fymble.app to attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days.

16. Platform-Specific Terms

16.1 Apple App Store Users

For users who download Fymble from the Apple App Store:
  • These Terms are between you and Fymble, not Apple
  • Apple has no obligation to provide support or maintenance
  • Apple is not responsible for the App or its content
  • Apple is a third-party beneficiary of these Terms
  • In case of third-party intellectual property infringement claims, Fymble (not Apple) is responsible

16.2 Google Play Store Users

For users who download Fymble from Google Play Store:
  • These Terms are between you and Fymble, not Google
  • Google has no obligation or liability concerning the App
  • Your use must comply with Google Play’s Terms of Service

Part B — Gym Mate Terms of Use

The following terms apply specifically to the Gym Mate feature within Fymble. By using Gym Mate, you agree to these additional terms in conjunction with the general Fymble Terms and Conditions above.

17. Eligibility

You must be at least 18 years of age to use GymMate. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate and complete.

18. Account & Profile

  • You are responsible for maintaining the security of your account credentials
  • Your profile information — including your name, photos, fitness bio, preferences, and workout goals — must be truthful and not misleading
  • You may upload up to 3 profile photos and post stories. All uploaded content must be yours or used with permission
  • Fymble reserves the right to remove content or suspend accounts that violate these terms

19. Gym Mate Sessions

  • You may create workout sessions by selecting a Fymble-partnered gym, date, time, fitness level, mate preference, and workout type
  • Your session will be visible to nearby users who may send you a join request
  • You may accept or decline incoming requests at your discretion
  • Accepted connections open a group chat for coordinating your workout
  • Sessions are intended for genuine fitness meetups. Misuse of sessions for solicitation, advertising, or any non-fitness purpose is prohibited

20. Daily Pass & Payments

  • GymMate allows you to book daily gym passes at partnered facilities
  • All purchases are processed through the app and are subject to the pricing and refund policies displayed at the time of booking
  • Fymble does not guarantee gym availability and is not responsible for facility conditions or third-party service quality

21. Messaging & Communication

  • You may send direct messages to friends and participate in session group chats
  • All communication must be respectful. Harassment, threats, hate speech, sexually explicit content, spam, or unsolicited promotions are strictly prohibited

22. Social Features

  • You may send and receive friend requests, view mutual connections, and build your fitness network
  • Stories you post may be set to Public (all GymMate users) or Friends Only. You are responsible for the content you share
  • Unfriending or blocking a user will restrict their access to your profile, stories, and messaging

23. Prohibited Conduct (Gym Mate)

In addition to the general prohibited uses, you agree not to:
  • Impersonate another person or misrepresent your identity
  • Post content that is violent, abusive, defamatory, obscene, or promotes illegal activity
  • Use the platform for commercial solicitation, scams, or fraud
  • Collect or harvest other users’ personal information
  • Interfere with or disrupt the service, servers, or networks
  • Circumvent any safety, moderation, or security features
  • Create multiple accounts or use automated tools to access the service

24. Reporting & Safety

  • You may report users or content that violates these terms. Reports are reviewed by our team and appropriate action will be taken
  • You may block any user at any time. Blocked users cannot view your profile, stories, or send you messages
  • Fymble cooperates with law enforcement where required by applicable law

25. Content Ownership & Licence (Gym Mate)

  • You retain ownership of content you create and upload
  • By posting content on GymMate, you grant Fymble a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content within the service
  • Fymble may remove any content that violates these terms or applicable law without prior notice

26. Location Services

  • GymMate uses your device location to show nearby sessions, gyms, and users
  • Location data is collected only with your permission and is used solely for providing relevant matches and distance information
  • You may revoke location access at any time through your device settings

27. Gym Mate Disclaimers

  • GymMate is a platform for connecting fitness enthusiasts. Fymble does not verify the identity, background, or fitness qualifications of users
  • You meet and interact with other users at your own risk. Fymble is not liable for any harm, injury, or loss resulting from in-person meetups
  • The service is provided “as is” without warranties of any kind

General Provisions

28. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fymble regarding the App.

29. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

30. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

31. Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

32. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or government actions.

  • By email to your registered email address
  • By posting on our website

34. Language

These Terms are provided in English. Translated versions may be provided for convenience, but the English version governs in case of conflicts.

Kyra AI is a preventive AI health coach integrated into the Fymble app. It is designed to support your fitness journey by offering personalised guidance, tracking tools, and motivational features—all powered by artificial intelligence.

Kyra AI is NOT a licensed medical professional. It does not diagnose, treat, cure, or prevent any disease or medical condition.

Features & Capabilities

  • Fitness Q&A — Ask fitness-related questions and receive AI-generated guidance.
  • Daily Routine Tracking — Track workouts, diet, water intake, weight, steps, and gym check-ins only through user-provided data and not through external sources or any other means.
  • Personal Coaching — Get personalised coaching tips for stress management, sleep improvement, and overall well-being.
  • Nearby Gyms & Gym Mates — Discover nearby gyms for workouts and find gym mates for group workout sessions.
  • Scan & Log Food — Scan meals to receive detailed nutritional insights including calories, macronutrients, and more.
  • Personalised Diet Plans — Receive AI-generated diet plans with recipes tailored to your goals. The first 2-day plan is free. Extended plans require a Pro subscription.
  • Report Upload & Analysis — Upload health reports to receive nutritional insights and AI-guided recommendations.
  • Weekly Challenges — Participate in weekly fitness challenges for motivation and rewards.
  • Breathing Exercises — Access guided breathing exercises for relaxation and stress relief.

Terms of Usage

By using Kyra AI, you agree to the following terms:

  1. Eligibility
    You must be at least 18 years of age to use Kyra AI.
  2. Acceptable Use
    You agree to use Kyra AI only for personal health and fitness purposes. You must not use the service to generate harmful, abusive, misleading, or illegal content.
  3. AI-Generated Content
    All responses from Kyra AI are generated by artificial intelligence. While we strive for accuracy, responses may occasionally be incomplete, inaccurate, or not applicable to your specific situation. You acknowledge that AI-generated content should not replace professional advice.
  4. Free & Pro Features
    Certain features such as Unlimited Chats, extended diet plans, advanced insights, and Scan & Log Food are available exclusively to Pro (paid) subscribers. Free users receive limited access as specified within the app.
  5. Content Ownership
    Content you create (messages, food logs, workout data) remains yours. By using the service, you grant Fymble a limited licence to process this content solely for the purpose of delivering the service.
  6. Service Availability
    Kyra AI is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. Features may be modified, updated, or discontinued at any time.
  7. Account Responsibility
    You are responsible for maintaining the security of your account and for all activities that occur under your account.

AI Limitations & Accuracy

  • Kyra AI does not have access to your complete medical history and cannot make clinical decisions.

Community & Social Features

When using community features such as Gym Mates, you agree to the following:

  • Be respectful and courteous to other users at all times.
  • Do not share personal contact information, financial details, or sensitive information through in-app social features.
  • Report any inappropriate behaviour, harassment, abuse, or safety concerns to our support team.
  • Fymble is not responsible for any interactions, meetings, or outcomes that occur between users outside the application.
  • Group workout meet-ups arranged through the app are undertaken at your own risk. Always exercise appropriate caution when meeting other users in person.

Subscriptions & Payments

  • Free features are available to all registered users at no cost.
  • A Pro Subscription unlocks premium features including extended diet plans, advanced AI insights, and Unlimited Chats.
  • Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.
  • You may cancel your subscription at any time through your device’s App Store or Play Store settings. Cancellation becomes effective at the end of the current billing period.

Prohibited Uses

You must NOT use Kyra AI to:

  • Seek diagnosis or treatment for medical conditions.
  • Generate content that is harmful, abusive, discriminatory, misleading, or illegal.
  • Attempt to extract, reverse-engineer, manipulate, or exploit the AI system.
  • Share AI-generated health advice as professional medical guidance.
  • Use the service for any commercial purpose without prior written permission from Fymble.
  • Impersonate healthcare professionals or represent AI-generated responses as medical advice.

Updates & Changes

  • We may update these Terms & Conditions from time to time. Continued use of Kyra AI after changes constitutes acceptance of the revised terms.
  • New features may be introduced and existing features may be modified or discontinued at our discretion.
  • Significant updates to these Terms & Conditions will be communicated through in-app notifications.
  • We encourage you to review these Terms & Conditions periodically to stay informed of any changes.
